OrganicsOnline is a web based business in the organics industry that markets organic products through an internet based shop.

1. DELIVERY AND AVAILABILITY POLICIES

1.1 DELIVERY

Subject to availability and receipt of payment, requests will be processed within 2 working days. Our courier service and the post office both have tracking facilities to allow for the tracking of the customers delivery, utilising a weighbill or a tracking number.

1.2 EXPORT RESTRICTION

The offering on this website is available to South African clients only

1.3 AVAILABILITY AND REFUNDS

1.3.1 Organics Online aims to keep stock all products (excluding fresh produce) offered on the site. Despite this, the provision of goods and services by Organics Online is subject to availability. In cases of unavailability, Organics Online will refund the client in full within 30 days.

1.3.2 Cancellation of orders by the client will attract a 15% administration fee.

1.4 DOMICILE

1.4.1 This website is governed by the laws of South Africa and Organics Online chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

1.4.2 This website is run by Pearl Isle Trading 5 Pty Ltd based in South Africa trading as Organics Online.

1.5 PRICES

1.5.1 The price of each product is displayed with the product. When placing an order our shopping cart software automatically totals your order price including the cost of the items and the shipping charges.

2. PAYMENT AND SECURITY

2.1 Credit card payments:

2.1.1 At the time of placing the order, the transaction details are presented to the bank and an authorization is obtained for the amount of the order. We process the payment and notify you if the authorization has been successful. If it is successful your we aim to ship your items within 2 working days.

2.1.2 Payment may be made via Visa or Master Card credit cards.

2.1.3 Credit card transactions will be acquired for Organics Online by PayGate (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa. PayGate use Secure Socket Layer 3 (SSL3) and no credit card details are stored on the Organics Online website. Users may go to www.paygate.co.za to view their security certificate and security policy.

2.1.4 Customer details will be stored by Organics Online separately from card details which are only entered by the client on PayGate?s secure site. For more detail on PayGate refer to www.paygate.co.za.

2.2 Bank Transfer Payments:

2.2.1 Payment may also be made by bank transfer into the Organics Online bank account, the details of which are available on the website.

2.3 Currency Of Payments:

2.3.1 The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is ZAR (South African Rand).

3. AGREEMENTS OF SALE

3.1 An agreement of sale between Organics Online and a user only comes into effect if and when:

3.1.1 A credit card authorization is received from the issuing bank; or

3.1.2 Organics Online reserves the right to refuse to accept and/or execute an order without giving any reasons.

3.2 In the event that goods are delivered prior to a full payment being made:

3.2.1 Such goods remain the property of OrganicsOnline.co.za until they have been paid for in full.

4. GIFT VOUCHERS

4.1 Vouchers cannot be exchanged for cash and are not transferable.

4.2 Vouchers must be redeemed at Organics Online towards the purchase of products listed online.

5. GUARANTEE

5.1 If a user is not satisfied with their purchase, he/she may return a purchase within 28 days of receipt:

5.1.1 If Organics Online supply the wrong product or if the product is in any way faulty or damaged, Organics Online will exchange it for the correct one. Organics Online will make a reasonable effort to exchange the product, but if replacement is not possible, Organics Online will refund the purchase price including delivery cost.

5.1.2 If the user is not satisfied with his/her choice and the product is still in mint condition, the user may return it and Organics Online will refund the purchase price (excluding delivery costs).

6. PRIVACY

6.1 This site collects private information from users, such information shall not be disclosed to any third party unless agreed upon between the user and Organics Online or through due legal process. Users agree that Organics Online may, from time to time communicate with users.

6.2 Organics Online shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).
